Plant Performance

Except for the express coverage provided by the Better Trees Promise, White Oak Orchard does not guarantee survival, growth rate, mature size, nut or acorn production, crop yield, wildlife attraction or other specific results. Plant performance depends on factors beyond our control, including climate, soil conditions, planting methods, watering, maintenance, wildlife, pests, disease and weather.

Agricultural Restrictions

Customers are responsible for confirming that the species ordered may legally be planted at the delivery location. White Oak Orchard may cancel or restrict an order when required by federal or state agricultural laws, quarantines or shipping restrictions. If White Oak Orchard cancels an unshipped item for this reason, the customer will receive a refund for the canceled item and any directly associated shipping charges.

Applicable Consumer Rights

Nothing in this policy is intended to limit or exclude any customer rights or remedies that cannot legally be waived under applicable federal or state law.
